Bright Photos S.L. – Terms & Conditions
By visiting or using any website owned by Bright Photos S.L., or by hiring Bright Photos S.L. for photographic services, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our website or services.
1. Ownership & Usage Rights
All photographs, videos, and related media created by Bright Photos S.L. remain the sole property of Bright Photos S.L. and are protected by copyright law.
A non-transferable licence is granted solely for the promotion of the specific property photographed, limited to digital publication for property sales marketing while the property is actively listed for sale. This licence permits use by the Client and their directly commissioned agents for marketing the property.
Once the property is sold or removed from the market, all usage rights are automatically revoked, and further use of the images or video is prohibited. This revocation includes, without limitation, photographs or video of any related development amenities, aerial photography, and aerial video.
Any other use — including print, commercial campaigns, or use by third parties — requires prior written consent.
No rights are granted until full payment is received.
2. Image Protection & Alterations
Images may contain visible or invisible watermarking. Unauthorised use, reproduction, or alteration (including cropping, colour changes, or watermark removal) without written permission is prohibited. Copyright violations will be pursued.
3. Portfolio Rights
Bright Photos S.L. retains the right to use all images — including both interior and exterior photographs — in its portfolio, marketing materials, publications, competitions, and exhibitions.
4. Image Delivery
Edited images and media will be delivered digitally via an online gallery or file transfer service.
Delivery will take place only after full payment has been received, unless otherwise agreed in writing.
Standard delivery is within 3 business days of the shoot; larger projects or video work may require additional time, which will be advised in advance.
Bright Photos S.L. is not responsible for delays caused by factors outside its control, including late provision of required information or materials from the Client.
5. Payment Terms
Payment is required in full once the proof images and/or video are ready for viewing in the online gallery, unless otherwise agreed in writing.
Download access to any images or video will only be provided once payment has been received in full.
If payment is not received within fourteen (14) business days from this point, the Client understands and agrees that they will be charged an additional 10% late payment fee upon the fourteenth (14th) business day and an additional 20% late payment fee per month thereafter.
After 30 days overdue, the outstanding balance may be referred to a debt collection agency or legal representatives, with all associated costs added to the Client’s account.
The Client will not be able to order additional services and any associated photographs or video will be disabled until the entire balance is paid.
6. Advanced Editing
Requests for complex or advanced editing beyond the standard service will be billed separately at an hourly rate, which will be advised in advance.
7. Re-Shoots
Re-shoots requested due to circumstances beyond the control of Bright Photos S.L. (e.g., weather, property readiness, access issues) will incur additional charges.
8. Cancellations & Postponements
If a booking is cancelled or postponed with less than 24 hours’ notice, Bright Photos S.L. reserves the right to charge a cancellation fee of 50% of the quoted fee.
If cancellation occurs on arrival or access is not provided at the scheduled time, the full fee will be charged.
Delays caused by the Client may also incur additional fees.
9. Travel Costs
Travel beyond 30km one way from La Quinta, Marbella, will incur a fuel surcharge of €2.15 per km.
10. Client Responsibilities
The Client is responsible for ensuring that the property is accessible, presentable, and safe for photography/videography at the scheduled time.
This includes arranging access permissions, ensuring all areas to be photographed are prepared, and notifying Bright Photos S.L. of any hazards on site.
If the property is not ready, Bright Photos S.L. may proceed with photography as-is or apply additional charges for delays or rescheduling.
11. Property Care & Liability for Damage
Bright Photos S.L. will take all reasonable care when working on-site; however, the Client is responsible for ensuring the property is safe and suitable for photography/videography.
Bright Photos S.L. is not liable for damage to the property or its contents unless such damage is caused by proven negligence.
In the event of proven negligence, liability is limited to the reasonable cost of repair or replacement of the damaged item, not exceeding the total fee paid for the services.
Bright Photos S.L. is not liable for pre-existing damage, wear and tear, or any issues arising from unsafe property conditions.
12. Force Majeure
Bright Photos S.L. will not be liable for any delay or failure to perform its obligations under these Terms if such delay or failure is caused by an event beyond its reasonable control, including but not limited to extreme weather, illness, accident, fire, flood, strike, equipment failure, or power outage.
In such cases, Bright Photos S.L. will work with the Client to reschedule the services at the earliest possible date.
13. Liability
Bright Photos S.L. is not responsible for the legal compliance of property advertising or for the sale of any property. We are not a staging company; properties are photographed “as-is”, and it is the Client’s responsibility to ensure readiness.
14. Indemnity
The Client indemnifies Bright Photos S.L. against any claims, damages, or expenses arising from the use of images without the necessary permissions or releases.
15. Modification & Refusal of Service
Bright Photos S.L. may amend these Terms at any time and reserves the right to refuse service at its sole discretion.
16. Governing Law
These Terms are governed by the laws of Spain, with any disputes to be resolved in Marbella, Málaga.
